Terms of sale

Article 1 — Purpose
These terms and conditions of sale govern sales concluded on the novani.fr site between:
HEXWEB LLC, a company incorporated under United States law (Limited Liability Company) registered in New Mexico, United States, whose registered office is at 8206 Louisiana Blvd NE, Ste A #10478, Albuquerque, NM 87113, United States, hereinafter “the Seller”,
and any natural person acting outside a business capacity who makes a purchase on the site, hereinafter “the Customer”.
Every order implies unreserved acceptance of these terms.
Article 2 — Products
The products offered are household textiles: mulberry silk pillowcases, woven in 22 momme, in the 48 × 74 cm (rectangular) and 60 × 60 cm (square) sizes.
Photographs and descriptions are provided for guidance. As silk is a natural fibre, slight variations in shade or appearance from one item to another are normal and do not constitute a lack of conformity.
The stated characteristics — composition, weight, dimensions, care — are verifiable and are binding on the Seller. No health claim or promise of results is associated with these products.
Products are offered while stocks last. Should an item be unavailable after an order is placed, the Customer is informed and refunded in full within 14 days.
Article 3 — Prices
Prices are shown in euros, all taxes included, excluding shipping costs. Shipping costs are shown before the order is finally confirmed.
The Seller is not subject to European Union VAT and therefore charges no VAT on its sales. As parcels are shipped from China, import VAT and the carrier's handling fee may be claimed from the Customer on delivery: the details are set out in the “Shipping” page.
The Seller reserves the right to change its prices at any time. Products are invoiced at the rate in force at the time the order is confirmed.
Article 4 — Orders
The Customer selects the products, checks the details of the basket, enters their contact details and confirms the order. Confirmation constitutes acceptance of the prices, the descriptions and these terms.
A confirmation email summarising the order is sent to the Customer. The contract is formed from the moment that email is sent.
Article 5 — Payment
Payment is made online at the time of the order, by the means offered at checkout. Transactions are secured by the payment provider.
The Seller has access to none of the Customer's banking data.
Article 6 — Delivery and product origin
The products are woven and made in China, and shipped from China. This information is brought to the Customer's attention before the contract is concluded.
The delivery time is 6 to 12 days in mainland France, preparation and transit included. Under article L.216-1 of the French Consumer Code, delivery takes place no later than thirty (30) days after the contract is concluded; failing that, the Customer may cancel the order and obtain a full refund.
For destinations outside the European Union, customs duties or local taxes may be due on receipt and remain payable by the recipient.

Article 7 — Right of withdrawal
Under article L.221-18 of the French Consumer Code, the Customer has fourteen (14) days from receipt of the order to exercise their right of withdrawal, without having to give reasons for their decision.
This right applies in full: silk pillowcases fall under none of the exceptions provided for in article L.221-28. The product must come back in a condition that allows it to be resold — unwashed, unused, with its packaging.

Article 8 — Statutory guarantees
All products benefit from the statutory guarantee of conformity (articles L.217-3 et seq. of the French Consumer Code) and from the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code).
The statutory guarantee of conformity applies for two years from delivery of the goods. The Customer may request the repair or the replacement of the product and, failing that, a price reduction or the cancellation of the sale. These guarantees are exercised free of charge.
The Seller alone is answerable to the Customer for the proper performance of the contract, whoever its own suppliers may be.
Article 9 — Care and liability
Care instructions appear on the product page and on the label: machine wash at 30 °C, air dry, no fabric softener.
The Seller cannot be held liable for damage resulting from failure to follow these instructions, in particular washing at a high temperature or tumble drying.

Article 11 — Disputes and mediation
These terms are governed by French law.
Failing an amicable resolution, the French courts have jurisdiction.
